Apple and Samsung are in on again, off again talks about settling their dozens of global patent disputes for the past year.
Currently, they’re on again.
The two companies have been chatting recently, according to a Wall Street Journal report, including in face-to-face meetings in Seoul, Korea. They almost reached a settlement this February, apparently, before cooling down.
Apple and Samsung, however much they may fight in court, are major partners, with Apple buying billions of dollars of mobile chips and memory from Samsung over the past years. Just this past week, the two companies gritted their teeth and signed a contract for Apple A9 processors. Apple has been trying to move to Taiwan Semiconductor for at least some and possibly all of its chip needs, so the Samsung deal may be evidence that the alternately cold and hot war between the two mega-corporations could be subsiding.
Apple’s biggest win over Samsung was a billion-dollar judgement in Justice Lucy Koh’s San Jose courtroom. Samsung’s biggest win over Apple was an International Trade Commission judgement that bans the importation of various iPhone and iPad models. Both companies have turned over similar sales bans, and these two judgements are both in appeal.
The reality is, both Apple and Samsung have spent millions — if not hundreds of millions — in courts from Korea to California to Europe, and neither has really won anything significant yet. Apple has been free to release its iPhone 5 and iPad updates. Samsung was not blocked from selling the Galaxy S III or the new Galaxy S 4.
It’s time for this to end.
Apparently the companies came as close in February as creating a memorandum of understanding, and discussions are still ongoing. Let’s hope it’s something both can build on to arrive at a final solution.
